Please read this End User License Agreement (“Agreement”) carefully before installing or using Pit Panic. By installing, accessing, or using the Game, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree, do not install or use the Game.

marty+support@flying-rat.studioThis Agreement governs your access to and use of Pit Panic, including its game software, online leaderboards, telemetry features, and related services (collectively, the “Game”). It applies across all supported platforms.
Pit Panic is available on the following platforms:
Some features, including leaderboard rankings, may vary depending on the platform or applicable platform terms of service. Leaderboards are platform-specific: PC players across all PC storefronts share a unified leaderboard, while each console platform maintains its own separate leaderboard.
Flying Rat Studio grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Game solely for personal, non-commercial entertainment purposes.
The Game is licensed, not sold. Nothing in this Agreement transfers any ownership rights in the Game to you.
By accepting this Agreement, you confirm that you are of legal age to enter into binding contracts in your jurisdiction, or that you have obtained verifiable consent from a parent or legal guardian.
Use of the Game by minors is subject to parental or guardian consent where required by applicable law.
The Game does not require special account creation or login. A pseudonymous technical identifier may be generated and used for leaderboard functionality and service integrity purposes.

The Game collects gameplay telemetry data to support core features including online leaderboards. This data is processed through Microsoft PlayFab, a third-party backend service.

The Game includes online leaderboards that display player nicknames sourced from your platform account. The Game does not include chat functionality, user-generated content tools, multiplayer, or in-game purchases.
Online features require a stable internet connection and depend on third-party infrastructure, including Microsoft PlayFab.
Flying Rat Studio does not guarantee the availability or performance of online features at all times.
Your leaderboard nickname is derived from your platform account (e.g. Steam, PlayStation Network, Xbox, Nintendo). You are responsible for ensuring your platform nickname complies with this Agreement and applicable platform policies.
Nicknames that are offensive, discriminatory, defamatory, or otherwise inappropriate are prohibited.
Flying Rat Studio reserves the right to remove or restrict leaderboard entries that violate this provision.
You may not:
The Game may be updated, modified, or have features added or removed at any time. Certain updates may be required to continue using the Game.
Flying Rat Studio is not liable for any impact such changes may have on your experience.
All intellectual property rights in the Game, including but not limited to software, graphics, music, audio, and design, belong exclusively to Flying Rat Studio or its licensors.
Nothing in this Agreement grants you any rights beyond the limited license set out in Section 3.
If you violate this Agreement, Flying Rat Studio may take appropriate action, which may include issuing a warning, temporarily suspending your access to online services or leaderboards, or permanently banning your access to online features.
Actions will be proportionate to the nature and severity of the violation where reasonably practicable.
The Game and its online features are provided “as is” and “as available” without any warranty of uninterrupted service, error-free operation, or fitness for a particular purpose.
Flying Rat Studio reserves the right to suspend or discontinue online services, in whole or in part, at any time and without liability.
To the fullest extent permitted by applicable law, Flying Rat Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to your use of the Game.
To the extent that liability cannot be excluded under applicable law, Flying Rat Studio’s total aggregate liability to you shall not exceed the amount you paid for the game.
Nothing in this Agreement excludes or limits liability that cannot be excluded under applicable mandatory consumer protection laws in your jurisdiction.
This Agreement remains in effect until terminated. You may terminate this Agreement at any time by uninstalling the Game and ceasing all use of it.
Flying Rat Studio may terminate this Agreement, or suspend your access to online features, if you materially breach any provision of this Agreement and fail to remedy such breach within a reasonable time of being notified.
Upon termination, your license to use the Game ends immediately. The following sections survive termination and remain in effect: Section 11 (Ownership and Intellectual Property), Section 14 (Limitation of Liability), Section 16 (Governing Law), and any provisions that by their nature should survive.
Following termination, any pseudonymous technical identifiers associated with your use of the Game will be handled in accordance with our Privacy Policy.
This Agreement is governed by the laws of the Czech Republic, without regard to its conflict of law provisions. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the competent courts of the Czech Republic, except where mandatory provisions of applicable local consumer protection law require otherwise.
If you are a consumer resident in the European Union, you may also have access to the EU Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr
Flying Rat Studio may update this Agreement from time to time. When material changes are made, we will notify you via an in-game notice or other reasonable means prior to the changes taking effect.
If you do not accept the updated Agreement, you should stop using the Game. Continued use of the Game after the effective date of the changes constitutes acceptance of the revised Agreement.
Your use of the Game involves the collection of telemetry data and a pseudonymous technical identifier as described in Section 6.
